Terms and conditions of trade and delivery

General

Sales from www.sweetway.dk are made by Sweetway ApS, CVR-nr. 43545949, Smallegade 43 st 3, 2000 Frederiksberg who owns and operates the site. These sales and delivery terms apply to all purchases of goods on www.sweetway.dk for delivery in Denmark. Delivery in Denmark does NOT include Greenland and the Faroe Islands, nor is delivery to other countries abroad.

These terms and conditions are updated continuously. Therefore, please accept the terms and

conditions (the “terms”) every time you shop with us. If the terms and conditions are not accepted, it is not possible to shop at www.sweetway.dk 


Ordering 

You can shop at www.sweetway.dk around the clock. However, the website may be closed for shorter periods in connection with maintenance, etc. Orders are not processed on weekends and holidays, but will be processed as quickly as possible on weekdays.

To shop at www.sweetway.dk you must be 18 years of age and have a valid payment card that we accept. If you are not yet 18 years of age, you can still purchase goods if you have obtained your guardian’s consent or otherwise have the legal right to make the purchase.

When you place an item in your cart, we reserve the selected item for you. If you do not complete your order and are inactive on the site for 10 minutes, the items in your cart will be released for others to purchase. This means that you may find that items you had placed in your cart have been sold out.

Your order is complete when your payment is approved and you see a receipt on your screen.

By placing an order on the website, you are making an offer to purchase the ordered goods on the terms and conditions set out in these terms and conditions.

We are free to choose to accept or decline your offer to purchase the item in one of the following situations:

  • Incorrect payment information has been provided and/or the payment information provided cannot be verified.
  • There is reasonable suspicion that the order was placed with the intention of committing fraud or in relation to a criminal/illegal act/activity.
  • In the event of unintentional errors on the website that prevent the correct completion of the transaction, e.g. payment errors, price information errors, etc.
  • If you suspect that you do not comply with point 2.2 above.

When ordering multiple items at the same time, we reserve the right to partially accept the order and decline offers to purchase additional items under the same order. We will of course refund any payments received for undelivered items without any fees or other costs to you.

Sweetway is not responsible for any costs associated with the rejection of an offer to purchase in the above cases.

Sweetway only accepts offers made on www.sweetway.dk, and offers made in other ways, e.g. via e-mail, letters and fax, will not be processed.


Purchase agreement

It is possible to edit your order until you complete your order by clicking “Pay”. You are then bound by your offer to purchase.

When you have ordered an item on www.sweetway.dk, you will receive a receipt for our receipt of your order.

The receipt, which you receive by e-mail, is an automatically generated confirmation that we have received your

offer. The receipt does not constitute acceptance of your offer, and we reserve the right to reject your offer to purchase, despite the automatically generated receipt.

If we accept your offer to purchase, you will receive an e-mail from us with an order confirmation, confirming that we have accepted your offer to purchase. You will receive the order confirmation when the webshop is ready to ship your

order. The final purchase agreement between you and Sweetway is concluded from the time you have received the order confirmation. The purchase agreement is concluded in Danish.

After the agreement has been concluded, the rules of the Danish Consumer Contracts Act on the right of withdrawal apply. You can read more about the right of withdrawal under point 7 below.


Payment

At www.sweetway.dk, payment can be made using a payment card or via Mobilepay.

You can pay with the following card types:

Your payment will be withdrawn from your account once we have shipped your order from our warehouse. Payment is in Danish kroner (DKK).


Pricing 

Prices stated on www.sweetway.dk follow Sweetway own recommended prices and include VAT and taxes. Prices are updated continuously.

For purchases under DKK 499, a shipping fee of a maximum of DKK 59 will be added, depending on the chosen delivery method. You can read more about delivery and delivery prices under point 6 below.

Reservations are made for typos, price errors, sold-out items, discontinued items, printing errors, and price and tax changes.


Delivery 

It is our goal to process our orders as quickly as possible. We aim for a delivery time of 1-3 business days for in-stock items. You will automatically receive an email when your order is shipped from our store. Items will be delivered to the delivery address provided when ordering.

An employee from Sweetway will contact you if there are any delays or problems with your order.

Deliveries are made exclusively to addresses in Denmark, excluding the Faroe Islands and Greenland.

Sweetway offers delivery with GLS and Neo Logistics. The prices are as follows: 

GLS without distribution – 39 kr.

GLS with distribution – 59 kr.

Customized Cakes delivery prices are calculated individually 

Orders of a minimum of DKK 499 are delivered free of charge, regardless of the chosen delivery method.

We reserve the right to make separate deliveries. Separate deliveries may be necessary, e.g. due to

delayed goods or if an item is not in stock. You will be informed prior to purchase that your order is subject to separate deliveries. You will not be charged additional delivery costs in cases where we exercise our right to make separate deliveries.

Cancellation 

When you shop at www.sweetway.dk, you have a 14-day right of withdrawal according to the

Consumer Contracts Act, during which you can notify us that you regret the purchase and then return the goods to us.

This does not apply to food. For hygiene reasons, the right of withdrawal only applies to unopened, sealed goods and never to food. It is a prerequisite that the goods appear unused and undamaged when returned, so that they can be sold again as new.

The beginning and expiry of the withdrawal period

The right of withdrawal runs from the day you receive the goods. If the period expires on a Sunday, public holiday, Saturday, Constitution Day, Christmas Eve or New Year’s Eve, the period is extended to the next working day. In the event that the order consists of several different goods that are ordered in one order but are delivered individually, or the order consists of a good that is delivered in several batches, the period runs from the receipt of the last good.

Use of the right of withdrawal 

In order to assert the right of withdrawal, you must notify us of this by means of an unambiguous declaration no later than 14 days after receipt of the goods at [email protected]  

The declaration must be sent before the expiration of the withdrawal period.

Once we have received your cancellation notice, we will acknowledge receipt of it.

The goods must be sent to us as soon as possible after you have given notice of withdrawal – and no later than

14 days after you have withdrawn. The deadline is met if you have sent the goods before the expiry of the 14 days.

The item is returned to us by enclosing a note with the items to be returned, name, address, phone number and email address and sending the item to:

The return package must contain either the invoice, order confirmation or other documentation for your purchase. When returning, you should ensure that the items are properly packaged. You are responsible for the package/item until we receive it. Therefore, save the postal receipt and any track and trace number.

You must bear the costs of returning the goods when you exercise your right of withdrawal. 


Refund 

When we receive the goods, we will check them and you will be refunded the amount you paid to us for the purchase, excluding postage. The refund will be made no later than 14 days after we have received your notice

of cancellation.

Refunds may be withheld until Sweetway has received the returned goods, or until documentation has been provided that the goods have been returned correctly. Any costs associated with delivery of the goods will not be refunded.

The amount will always be transferred to the same payment method with which you paid for the purchase, unless you have expressly agreed otherwise. In any case, you will not be charged any fees as a result of the refund.

You are liable for any deterioration in the value of the goods caused by handling other than that which was necessary to determine the nature, properties and functioning of the goods. If the goods have been handled in a manner other than that described above, we consider them to be used, which means that if you cancel the purchase, you will only receive a part

or none of the purchase price back, depending on the commercial value of the used goods. If the packaging is broken/opened, the goods cannot be returned, see section 7.2. The deterioration in value is the difference between the purchase price and

the general commercial selling price of the goods with the deterioration in question.

You bear the risk of the goods from the time of delivery. This means that you are liable for any damage that has occurred to the goods from the time you received the goods until we have received the goods back.


Complaint

If there is something wrong with the product Your purchase is covered by the Danish Sales Act, including the law’s defect rules. You therefore have a 2-year right of complaint. This means that you can either have a defective product repaired, replaced,

refunded or discounted, depending on the specific situation. In some cases, you may also be eligible to withdraw the purchase. These powers, of course, only apply if there is a legitimate complaint and if the defect in the goods has not arisen as a result of wear, misuse or other conduct which has caused damage to the goods.

You are not responsible for any costs associated with returning defective or incorrect items. We will of course refund the purchase price and original delivery costs once we have received the returned item. If you would like us to deliver a similar item to you, and we are able to do so, we will not refund your original delivery costs. However, we recommend that you do not return the defective or incorrect item without first contacting our customer service.


How to complain 

You must complain as soon as possible and no later than 2 months after you have discovered the defect in the product. If your product suffers from a defect, or we have delivered the wrong goods, please contact our customer service via email to [email protected]  or by phone at 53 33 36 63.

When you contact customer service, you must provide the order number, if applicable, the item number, the item name, the net weight and, if applicable, the best before date and batch number, as well as a description of what is wrong with the item. If possible, a picture showing the defect may also be attached. Depending on the specific situation, you will receive further instructions. If we have the right to return the defective item, e.g. in connection with a replacement or cancellation of the purchase, the item must be sent to:

The item must always be sent in proper packaging. We recommend that you ensure that you get a receipt for shipping, as you are responsible for the package until we have received it.

You must pay for shipping costs in connection with the return of defective goods. We do not accept packages sent by cash on delivery. If the complaint is justified,we will of course refund your reasonable shipping costs for returning the item. If the complaint is not justified, you must pay all shipping costs associated with returning the item. We recommend that you do not return the item without first contacting our customer service.

There may be cases where Sweetway needs to receive the defective product (including the packaging) so that we can carry out quality follow-up and possibly forward the product to our supplier. In such cases, Sweetway will bear the costs of transport.


Complaints

If you want to complain about your purchase, please contact our customer service. If we are unable to find a solution, you can file a complaint with the Center for Complaints Resolution, Nævnenes Hus, Toldboden 2, 8800 Viborg. You can complain to the Center for Complaints Resolution via this link.

The European Commission’s online complaint portal can also be used to file a complaint. This is particularly relevant if you are a consumer residing in another EU country. Complaints can 

be filed here – https://ec.europa.eu/odr.

Security 

At www.sweetway.dk we use a secure online payment solution through Stripe.

Stripe uses a secure, encrypted connection to transfer your payment information to Sweetway. Using Stripe payment window ensures that no one else has access to your payment information.

When purchasing goods on www.sweetway.dk, you only need to enter your card number, expiration date and check digits (Credit Card Verification Number (CVV)). The check digits are necessary for the payment to be completed and to maintain a high level of security. There may also be other similar security measures.

In order to protect you and other customers from fraud and to ensure a high level of security for online purchases, we may conduct verification checks. The verification check may include the data you submit when you submit your offer, including your address, payment information and screening of your offer.

Sweetway will never call or send messages with requests to provide payment card details.

Other conditions

We do our best to update the website and ensure that prices, offers, descriptions and other information about the goods are correct. However, spelling errors, errors in prices, offers, descriptions and other information about the goods may occur, and sometimes we discover that the price of an item is stated incorrectly. If we discover an error in the

price of an item you have ordered on the website, we will notify you as soon as possible. In these circumstances, we will inform you of the correct price for the item and give you the opportunity to purchase the item at the correct price. If we are unable to contact you, we may exercise our right not to accept your offer to purchase.

In the event of force majeure, we will not be liable for any delay or failure to perform our obligations under the Terms if the delay or failure is due to events beyond our reasonable control.

Goods may not be purchased on www.sweetway.dk for the purpose of resale without entering into a separate agreement. Agreements can be made by contacting us at [email protected]
